Telework Tax Credit

Georgia is the first state in the nation to offer employers a telework tax credit. Under this law, employers are eligible for a one-time tax credit of up to $20,000 to offset design and assessment costs, plus annual credits of up to $1,200 per new teleworker.

Details

The Georgia Telework Tax Credit (Code 48-7-29.11) allows qualified employers to receive a tax credit in 2009:

  • Up to $20,000 tax credit for planning, consulting, training and/or raw labor costs associated with starting or expanding a telework program
  • Additional tax credit of $1,200 per new teleworker created in 2009. Eligible expenses include equipment (computers, telecommunications, data entry, data processing), software and maintenance

The Georgia General Assembly has allotted up to $2 million in credits for the 2009 tax year. Employers will be informed of acceptance by December 31, 2008. Credits will be taken after purchases or payment in the form of a credit for the 2009 tax year. If the amounts of credits requested exceed the budgeted $2 million, then funds will be dispersed among employers on a pro-rata basis.

Eligibility

Businesses that will pay state of Georgia income tax in 2009 are eligible for the tax credit. Businesses located in areas that have been designated as “nonattainment” for federal air quality standards may claim up to 100 percent of the credit for teleworkers who telework 12 or more days per month, while those outside nonattainment areas may claim up to 75 percent. For teleworkers who telework 5 or more days per month (regardless of attainment or nonattainment designation) employers may claim up to 25 percent of the credit.

A simple three-page application for the Georgia Telework Tax Credit must be submitted to the State Revenue Commissioner by October 31, 2008.
